COUNTY OF DAKOTA

AN ORDINANCE RELATED TO THE REGULATION OF STREETS, HIGHWAYS, AND PARKING IN THE CITY OF VERMILLION

AMENDING THE VERMILLION CITY CODE BY REPEALING ORDINANCES 6 AND 6A, AND ADOPTING A NEW ORDINANCE 6B

The City Council for the City of Vermillion Ordains:

1. Repealing Ordinance 6. Ordinance 6 of the Vermillion City Code, adopted on June 18, 1963, is repealed in its entirety, and shall no longer be of any force or effect.

2. Repealing Ordinance 6A. Ordinance 6A of the Vermillion City Code, adopted January 2, 1973, is repealed in its entirety, and shall no longer be of any force or effect.

3. Adding Ordinance 6B. Ordinance 6B shall be added to the Vermillion City Code and shall read as follows:

PARKING REGULATIONS

SECTION 1. DEFINITIONS. For the purposes of this ordinance, the words and phrases contained in Minnesota Statutes, Chapter 169, the Highway Traffic Regulation Act (“Act”), as may be amended from time to time, are hereby adopted by reference for the regulation of traffic upon the streets and highways of the City, and shall have the meaning given by the Act, except as follows:

Block means the entire length of a roadway between its intersections with other public streets or between its intersection with a public street and the termination of the roadway.

Roadway means that portion of a street or highway between its curbs, or between the outer edges of its shoulders whether such portion is constructed of concrete, asphalt, or gravel, or any combination thereof.

Street or Highway means the entire width between the boundary lines of any way or place when any part thereof is open to the use by the public as a matter of right, for the purpose of vehicular traffic, whether such portion is constructed of concrete, asphalt, or gravel, or any combination thereof.

Vehicle means any motorized or non-motorized vehicle including, but not limited to, automobiles, trucks, motorcycles, buses, recreational vehicles, snowmobiles, and trailers, regardless of size, length, weight, or number of axles.

SECTION 2. PARKING AND STOPPING. The owner and/or driver of a vehicle of any kind shall not stop, stand, or park such vehicle, or any part thereof, in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or traffic control device:

(A) In front of or obstructing any public or private driveway, including the private driveway of the vehicle owner.

(B) In any manner on any street or highway so as to interfere with or interrupt the passage of other vehicles, including the passage of ingress or egress of vehicles to or from adjacent or nearby properties.

(C) In any location where it would impair or hinder any intersection sight lines, or where it would obstruct the clear view of approaching traffic from any direction.

(D) In any location that is opposite the direction of traffic.

(E) On a sidewalk or boulevard between sidewalk and roadway.

(F) On or within a cross walk.

(G) Within an intersection.

(H) Within twenty feet of a crosswalk at any intersection.

(I) Within ten feet of a fire hydrant, or within a marked fire lane.

(J) Within thirty feet of any arterial stop sign or sign indicating the direction for travel .

(K) On the roadway side of any vehicle stopped or parked at the edge or curb of a street or highway.

(L) At any place where official signs prohibit stopping, standing, or parking .

(M) Alongside or opposite any street excavation or obstruction when such stopping, standing, or parking would obstruct traffic.

SECTION 3. OTHER PARKING RESTRICTIONS.

(A) No person shall park a vehicle of any kind, or permit said vehicle, to stand upon any street, highway, or public way within the city in any place where official signs prohibit parking or alongside any curbing officially painted yellow .

(B) No person shall, for camping or recreational purposes, leave or park a house or camping or recreational trailer on any public street, highway, or other public way within the city.

(C) No person shall, for the purposes of displaying it for sale, leave or park a vehicle on any public street, highway or public way within the city.

(D) No parking, stopping or standing zones. The Council may, by resolution, designate certain streets or portions of streets as no parking or no stopping or standing zones, or as zones for parking by physically disabled persons, and may limit the hours in which the restrictions apply. If such a zone is designated:

(1) The City shall mark the zone by appropriate signs.

(2) Except when necessary to avoid conflict with other traffic or in compliance with the directions of a Sheriff’s Deputy or a traffic-control device, no person shall stop or park a vehicle in an established no stopping or standing zone where stopping or standing is prohibited.

(3) No vehicle shall be parked in a no parking zone during hours when parking is prohibited, except when permitted by state law and except that a vehicle may be parked temporarily in such zone for the purpose of forming a funeral procession

SECTION 4. REPAIRING VEHICLES ON A STREET. No person shall dump, throw, or drain any oil, grease, or other lubricants, or allow the same to make or allow to be made any washing, greasing, or repairing of a vehicle, on a street, except repairs necessitated by an emergency.

SECTION 5. ENFORCEMENT AND PENALTY.

(A) Responsible Party . In any prosecution charging a violation of the provisions of this ordinance, the presence of a vehicle of any kind that is stopped, standing, or parked in violation of the provisions of this ordinance, shall be prima facie evidence that a registered owner committed or authorized the commission of such violation.

(B) Law Enforcement Duties and Authority . The Office of the Dakota County Sheriff shall interpret and enforce the provisions of this ordinance and the state traffic laws within the City of Vermillion. Sheriff’s Deputies are authorized to direct all traffic within the city, either in person or by means of visible or audible signal, in conformity with this ordinance and the state traffic laws. During a fire or other emergency or to expedite traffic or safeguard pedestrians, Sheriff’s Deputies may direct traffic as conditions require, notwithstanding the provisions of this ordinance and the state traffic laws.

(C) Removal of Vehicles. Whenever any Sheriff’s Deputy finds a vehicle of any kind has been parked or stopped in violation of any provision of this ordinance, such Deputy is hereby authorized to move or tow such vehicle without notice to the owner, provide for the removal of such vehicle and the impounding of the same, or require the driver or other person in charge of the vehicle to move the same. Any such removal and/or impounding shall be at the expense of the owner of the removed and/or impounded vehicle.

(D) Penalty. Unless otherwise declared in the Act, any person who violates any provision of this ordinance is guilty of a petty misdemeanor, punishable in accordance with state law.

4. Summary Publication. Pursuant to Minnesota Statutes Section 412.191, in the case of a lengthy ordinance, a summary may be published. While a copy of the entire ordinance is available without cost at the office of the Vermillion City Clerk, the following summary is approved by the City Council and shall be published in lieu of publishing the entire ordinance:

Ordinance 2024-06, adopted on July 2, 2024, amends the City Code for the City of Vermillion by repealing Ordinance 6 and Ordinance 6A, each related to the regulation of Streets, Highways, and Parking in the City of Vermillion, and by adding a new Ordinance 6B regulating the same, and establishing the penalties attached to violation of the provisions of Ordinance 6B.

5. Effective Date. This ordinance shall become effective immediately upon its passage and publication according to law.
